There are nine justices on the Washington State Supreme Court. Only one is a white man.
There are, in various combinations, seven women, four non-whites, three Jews, two lesbians, a member of an Indian tribe, and a black immigrant from Trinidad. The chief justice is Hispanic.
This riot of diversity is handing down rulings that openly discriminate against white people. Last summer I did a video on its ruling in State v Sum, which explains that certain kinds of evidence can be used against a white criminal but must be thrown out if the criminal is non-white.
The race of the defendant is the only thing that matters. I know it sounds hard to believe, but watch my video or read the transcript. That ruling was written by Justice Mary Yu, the first Latina and first openly homosexual justice on the Washington State Supreme Court.
Now her colleague, Justice Raquel Montoya-Lewis has written another equally astonishing anti-white decision. Here she is, on the left with Mary Fairhurst, the justice she replaced on the court.
Justice Montoya-Lewis was born in Spain to an American Indian father and a Jewish mother, and is the only enrolled member of a tribe to sit on a state supreme court.
She was the Chief Judge of the Upper Skagit Indian Tribe, the Nooksack Indian Tribe, and the Lummi Nation before she made the almost unprecedented switch to judging state law rather than tribal law.
She wrote the decision in Henderson v Thompson, handed down in October.
This hair-raising ruling is practically unknown. I have seen it mentioned on only two obscure blogs.
In this case, a white woman, Alicia Thompson, rearended a black woman, Janelle Henderson. The black woman claimed the accident made a pre-existing condition so much worse she couldn’t even go out in public. She sued the white woman for $3.5 million in medical damages, a huge sum for a fender-bender. Alicia Thompson never denied she hit Miss Henderson; the only question was the amount of damages.
At trial, Miss Thompsons’s defense counsel showed surveillance video of Janelle Henderson at work, with no noticeable disability. This did not stop Miss Henderson from calling three black witnesses to testify about how badly the accident had hurt their friend. They all used the same phrase to describe what she used to be like before the accident: “the life of the party.”
Heather Jensen, a white woman, defended Alicia Thompson, and she did three things that the Washington State Supreme Court said could have injected race into the trial and biased the jury.
First, in her closing argument, she said it might not have been a coincidence that the three black friends all used the same phrase. They might have been coached to say Miss Henderson used to be “the life of the party.”
Second, defense counsel Heather Jenson said this about the black accident victim: “when it’s my turn to cross-examine her, she’s not interested in the search for truth; she’s interested in being combative.”
She also called her “confrontational.”
Third, Miss Jensen said Miss Henderson seemed more interested in money than in medical relief, because she didn’t even tell her doctor about the accident until someone gave her the idea she might be able to get $3.5 million in a lawsuit. The jury granted only $9,000 in damages.
Miss Henderson’s lawyer, a black woman named Vonda Sargent, filed an appeal, saying Miss Jensen’s comments evoked racial stereotypes about black women, and this so tainted the proceedings that there should be a new trial.
The trial judge, Melinda Young, refused to grant a new trial.
She saw nothing impermissible in Miss Jensen’s arguments. Miss Henderson appealed to the State Supreme Court — and won.
That means that if you agreed with the trial judge — that there’s no evidence the proceedings were racially biased — you’re just not as smart as seven women, four non-whites, three Jews, two lesbians, an Indian, and a Trinidadian.
They set the stage in in the very first paragraph of their ruling: “Racism is endemic, and its harms are not confined to any place, matter, or issue.”
And they quickly got to the central question: “whether an objective observer (one who is aware that implicit, institutional, and unconscious biases . . . have influenced jury verdicts in Washington State) could view race as a factor in the verdict.”
Please note: an “objective observer” is someone who believes in and can sniff out “implicit, institutional, and unconscious biases.”
If that gifted person says, “Yes! There was unconscious bias,” then the trial judge must order a hearing on whether the alleged victim of bias deserves a new trial.
The justices ordered such a hearing for Miss Henderson because “Thompson’s counsel primed the jurors with appeals to racial bias throughout the trial.”
The worst thing Heather Jensen did was to call Miss Henderson, the black opposing party “combative” and “confrontational,” because “these terms evoke the harmful stereotype of an ‘angry Black woman’.”
This was almost as bad: “Defense counsel’s argument that Henderson was exaggerating or fabricating her injuries appealed to these negative and false stereotypes about Black women being untrustworthy, lazy, deceptive, and greedy.”
And this was pretty awful, too: “Intimating that the Black witnesses had joined together to lie for the Black plaintiff could invite jurors to suspect them as a group and to make decisions based on biases about race and truthfulness.”
That was enough to claim racial bias, which then requires a hearing to determine whether there should be a new trial.
So what’s supposed to happen at the hearing? Innocent until proven guilty, right? Wrong! Even for a jaded guy like me it’s hard to believe, but “At that hearing, the party seeking to preserve the verdict — that’s whitey — bears the burden to prove that race was not a factor.”
This means poor Heather Jensen and her white client have to go before a judge and prove that race had nothing to do with the verdict.
That’s impossible. Even if they subpoenaed all jurors and compelled them to testify — which they can’t do — and every one of them swore on a stack of Bibles that race wasn’t an issue at all, Vonda Sargent could accuse them of unconscious bias. She could quote the supreme court ruling: “Racial bias can influence our decisions without our awareness.”
I can hear her cross-examination now: “Are you saying, before this court and under penalty of perjury, that you are conscious of everything of which you are unconscious? That you aware of everything of which you are unaware? Is that your testimony?”
Under these conditions, why even hold a hearing? The Supreme Court even said that the trial judge, Melinda Young, is disqualified to preside over it. That’s because, according to the justices, “She agreed with Thompson’s counsel that it was fair to describe Henderson’s demeanor during cross-examination as ‘combative’ and ‘confrontational,’ opining that this language should be excused because the term was ‘race neutral’ and tied to the evidence.”
If you call a black witness combative — even if she was a terror on the stand — that’s not race neutral. It’s racist.
So in any Washington State Court, if you are in litigation against a black and he gets a verdict he doesn’t like, all he has to do is claim there was implicit, institutional, or unconscious bias against him. You can’t prove there wasn’t, so you have to keep giving the opposing party — and this no doubt also applies to Hispanics or transexuals or American Indians or homosexuals or fat people or immigrants — new trials until he, she, or it gets a favorable verdict.
You can say that a white witness or lawyer is confrontational. Lawyers do it all the time. You can say that a white plaintiff is greedy or faking it or got his friends to lie for him. But if you say that about someone in a protected class, he can yell that you evoked unconscious bias in the jury, and you have to prove you didn’t. Why even go to trial? Just give a non-white plaintiff whatever he asks for.
These supreme court justices are as crazed as any sociology professor — with the crucial difference that they can legislate from the bench.
The Seattle Times has noticed this, and of course, thinks it’s great: “ ‘We’re not colorblind’: Two years after George Floyd, WA Supreme Court tries to chart a different path on race.”
Justice is supposed to be blind, but these judges are proud they aren’t.
And they’ve been hard at work. As this article notes: “The court has overturned decades-old hateful precedents, with little public notice. It has thrown out laws, vacating tens of thousands of criminal convictions. It has ordered pay raises to thousands of immigrant farmworkers.”
Note the words, “with little public notice.”
I know of no law journal or even a single mainstream news site that has mentioned either of the two outrageous rulings I have talked about. There are probably plenty more that are equally bad.
It’s easy to think of cases in which the color-blind language of the law has been applied in ways that were unfair. The gentle treatment of the BLM rioters versus long jail sentences for Jan 6 rioters is an obvious example.
But this state supreme court has gone much farther and written racial discrimination right into the law. Once that starts, immense damage can be done. And as the bench fills up with more “diverse,” anti-white zealots, that’s exactly what we will get.

Activist courts have gotten by with overturning jury decisions for decades. They keep getting bolder with their made up justifications. I’m sure they are getting tired of sending these cases back for new trials, sure it results in more legal fees for the lawyer tribe, but these ignorant juries made up of commoners are really dumb.
In the near future, juries will only recommend decisions, sort of like a suggestion box at work. Appeals courts will determine guilt or innocence and size of judgements. If the appeals courts get it wrong, then the Supreme Courts (Mullahs) will have final say.

After having read this superb, but utterly depressing article, I had different conclusions:
1) the US is a failed state and it would be best for all people living there know to break up into smaller nations (with the least violence possible).
2) the problems described above have only so much to do with race. Essentially it is about women. No better proof I think that women do not belong in the judicial system. No more female judges, lawyers, prosecutors, period. Same goes for women in most other professions. As a basic rule, women ought to be homemakers, get children and raise them well. Ask most people if obeying the law is a good thing and almost all will say ‘yes’. This conventional wisdom is, of course, wrong.
Most laws are passed to take advantage of you in one way or another. The tiny amount of laws that actually pretend to protect you are nullified by other laws that prevent that protection from occurring. The “law” then goes on to say that ‘ignorance of the law is no excuse’ in order to make you guilty of offenses you didn’t even know existed.

The situations of what people assume as courts has been largely unnoticed, and changes the last several decades, last six or seven years accelerated. After the last two years more people are questioning things, though needs to be more, and on everything. People may not relate to the article as they should, because they’re ignorant of the injuries that go on in courts, and tribalism or grouping concepts, compared to whites ignoring when one or another is affected, because too many continue depend on media. Another note, judges are supposed to be elected, though it has been going on that judges drop out before an election, so governors put in who they want, steered by others, which then they’re easily elected, because they’re already ‘there’. Some reminders aside, a few notes on supposed chief judge in the article. He was put in by a governor at the time, then ‘elected’ after that, supposedly, and of note, around the same time, another judge, was thrown under the media bus for making a supposed racist remark which was actually only citing fact.
Further on the chief judge, about sixteen years ago I believe, there was a transit type project, and a hundred or so houses were targeted, using ’eminent domain’. The homeowners and others who didn’t want the scheme brought lawsuit against it. The case was decided by this individual, which decision, it was bragged by those pushing it -was done in ‘ninety seconds’. It used to be that a judge takes a day or few to decide a case or portions of claims. Not in that instance. The individual, then, further, dictated the homeowners could not put on the matter as an initiative, stating they could not put it ‘on any ballot in any election.’
The houses were taken, the owners were paid what the ‘state’ dictated the value was, and told to vacate.
Then, there were supposed over-budget situations, and the project was canceled. The previous owners, then wanting their houses back, were told they would have to pay new assessed values, which were substantially more than they were dictated to accept from the state, taking their homes. Many could not afford to buy them back.
The main point is about larger, don’t bother looking for detail on situation noted, most is wiped now, the points are larger, and relate to everything, including the article, which people need to ask more questions, and failure to do so, and tribe with others, and keep going, on whatever it is, and not rely on lawyers, or media, these together should make a frame for effort, including question white oppression, and that aims are not about equality. For instance everyone should have revolted for the homeowners, and there have been many other incursions in Wa state, such as on speech and other things, though will cease here with suggestion others make notes, and watch the video. No, that’s not quite the case, Mr. Zard. President Trump did have success in cutting down both the illegal and legal numbers significantly. Nothing was put into legislation, so it was all overturned as soon as Zhou Bai Dien got into office.

A friend of mine is moving to Central America. In his words:

I’m an expat on Roatan Island, Honduras. I left the DFW area of Texas 16 years ago because I was fed up with the treadmill of ever more taxes used to murder people in the ME and more onerous laws enforced by morons in costumes to criminalize behavior that can’t identify a victim. After 9/11 I knew a police state was a certainty and got out. Where I am, there are no roosters crowing at sunrise, no neighbours who party until dawn, no dogs fucking each other in the street, no other stray animals, but plenty of heat so I don’t freeze to death in winter and where putting a stick into the ground becomes one of the many fruits or avocado that grow wild along with the marijuana. Taxes aside from a hefty sales tax amount to pocket change.
The gov’t is infinitesimally small compared with the US. I see a cop a few times a year and have never been subjected to a sobriety test, traffic stop or bribe request. I visit a gov’t office twice a year to renew my residency and driver’s license. Mostly I’m left alone which the average US resident can’t even begin to appreciate.
For every 10 gringos that move here, 9 go back after a short time usually at the insistence of the women. They want their Starbucks, entertainment venues, shopping malls and want no part of self sufficiency and especially self defense. These are the “voters” that demand the gov’t and services that they then complain about.
The concept of ‘traffic congestion” or a “traffic jam” doesn’t exist since there are no traffic lights and I can only think of 2 stop signs. I haven’t had vehicle insurance in 16 years. If I want to see a doctor, that happens a few minutes after I walk into the doctor’s office or hospital. Most drugs are over the counter and dirt cheap. I haven’t had medical insurance because it’s not needed. I once opened my arm up by being reckless with an angle grinder, had a surgeon, doctor, 2 nurses tend to my wound over a 2 hour period and the bill was US $0.50, 50 cents in the public hospital.
It is the 1st world that can afford the militarism and police state that is in the process of murdering their own people with genocidal mandatory vaccines, an out of control underclass protected by the legal system and national currencies headed toward toilet paper status. A lot of patents are for manufacturing improvements that reduce costs. Is the USA going to spend much money trying to improve steel-making for its little steel industry? On the other hand, China produces half of the world’s steel. The same argument apples to ship-building but car manufacturing is still 50-50 if you add US car manufacturing in other countries like China and Mexico.
There aren’t going to be US patents for windmill power generators because China is the big manufacturer of windmills. The same is less true for solar cells. Although the USA isn’t important as a manufacturer, the technology is less mature and fundamental research is still a US strength even if it’s not up to the current Chinese level except in the life sciences.

I too am a lifelong cat lover, and indeed the reason I watched the first of the three videos I’ve now watched was that I could see his cat in the still frame. Although my own last cat died more than ten years ago, she and her several predecessors were always quick to jump in my lap whenever I was on the phone. As I’m sure you know, when another human isn’t present, a cat, of course, will simply assume that you are talking to him or her. After all, what point could there be in talking to a machine when one can talk to a cat instead!

Taylor here makes the twin errors of thinking that because the law is written down, it has some definite meaning, and of mistaking fairness for an objective quantity. In reality, “the law” has no meaning whatsoever apart from its interpretation, and what’s fair, like beauty, is entirely in the eye of the beholder. Leftists make a valid point in saying that the white man’s law is racist; it embodies (or at least used to embody) the white man’s cultural norms and expectations. But it should be no surprise then that women and non-whites, with other cultural norms, see matters differently. Perhaps if the white men of Washington state had understood this, they never would have permitted such a monstrosity as a Supreme Court comprised of “seven women, four non-whites, three Jews, two lesbians, a member of an Indian tribe, … a black immigrant from Trinidad[, and a Chief Justice who] is Hispanic.”

1) Why it’s happening
White people have, as part of their cultural inheritance from Christianity and the Greek philosophy with which it was infused, a belief in the objective existence of ideas. Plato, in fact, invented a whole realm of these which he claimed were more real than visible reality itself. As a consequence of this culturally ingrained belief, whites are, for example, quite convinced that they are not really their bodies at all, but instead a “soul” trapped inside a body. Via a similar mental mechanism, they also find it convenient to believe in the objective existence of such fictions as “justice”, “fairness”, “good”, “evil”, “the law”, etc. This sort of idealism predisposes them to mistakes such as thinking that surely it won’t make any difference at all if the judge is a Chinaman, a Jew, or even a negro. Even Taylor believes it, since it’s clear he thinks that even if it does, it shouldn’t. Of course, that’s absurd. It does make a difference who interprets the law. It has to.
2) What to do about it
Universals such as “fairness” and the rest of the list cited above, and many more, are at the foundation of Western civilization. When a structure is erected on such an unstable and rotten foundation, the only thing to do is tear it down and start all over again.

From my perspective, all the evils in the world are a direct cause of the various mafias known as government. No system of justice is worth anything unless all people are equal before the court. Anyone familiar with firearms knows that pulling on a barrel of a shotgun can cause it to fire. Arbery has that one fatal “flaw” that is present in all black DNA, the misperceived “shame” of being “disrespected” (even if no “disrespect” occurred) and the need to immediately “do something about it” (instant gratification) without thinking of the consequences.
Arbery could (and should) have run off in any other direction, would not have been pursued, and would still be alive today. He chose to confront the man with the shotgun. Play stupid games, win stupid prizes.
